Terms and Conditions
This Rental Agreement ("Agreement") is entered into between Party Perfect LLC ("Company") and the renter ("Renter") for the rental of party equipment and/or accessories ("Rental Items") as described in the attached invoice or booking confirmation. By signing this Agreement, Renter agrees to the following terms and conditions:
1. Rental Period and Return:
1.1 The rental period begins on the date of pickup and ends on the date of return, as specified in the invoice or booking confirmation.
1.2 Renter agrees to return all Rental Items to the designated drop-off location in the same condition as received, with normal wear and tear expected, by the agreed-upon return time. Any late returns may be subject to an additional fee of $50 every hour past the return time.
2. Rental Fees and Payment:
2.1 Renter agrees to pay the total rental fee as specified in the invoice or booking confirmation.
2.2 A $150 refundable security deposit is required to secure the reservation and will be returned to Renter upon satisfactory return of all Rental Items.
2.3 Damages include but are not limited to: melted candle wax, cigarette or cigar smell, spills, water damage, chips, cracks and tears.
2.4 A non-refundable deposit of 50% of the rental price is required to confirm the reservation and will be deducted from the total rental fee.
2.5 Payment of the remaining balance must be made one week prior to the rental period start date.
2.6 If the remaining amount due is not paid renter will forfeit their 50% payment and the rental will be cancelled.
2.7 Accepted forms of payment include; Credit Card (Visa, Mastercard, Amex) Paypal or Venmo.
3. Care and Use of Rental Items:
3.1 Renter agrees to use the Rental Items in a careful and proper manner, following all applicable safety guidelines and instructions provided by Party Perfect LLC.
3.2 Renter will not make any alterations, modifications, or repairs to the Rental Items without the prior written consent of Party Perfect LLC.
3.3 Renter is responsible for the safekeeping of the Rental Items during the rental period and shall protect them from damage, loss, theft, or vandalism.
3.4 Rental items may not be left outdoors overnight no matter what the forecast calls for.
3.5 Renter shall not sublease or transfer the Rental Items to any third party without the prior written consent of the Company.
4. Damage, Loss, and Liability:
4.1 Renter is responsible for any damage, loss, or theft of the Rental Items during the rental period. Damages include but are not limited to: melted candle wax, cigarette or cigar smell, spills, water damage, chips, cracks and tears.
4.2 In the event of damage, loss, or theft, Renter shall promptly notify Party Perfect LLC and is liable for the repair or replacement cost of the affected Rental Items.
4.3 Renter acknowledges that Party Perfect LLC is not liable for any injury, loss, or damage incurred during the use of the Rental Items and assumes all risks associated with their use.
5. Cancellation and Refunds:
5.1 Renter may cancel the reservation within 24 hours of booking to receive a full refund. No refunds will be issued for cancellations made after 24 hours.
5.2 In the event that Party Perfect LLC is unable to fulfill the reservation due to unforeseen circumstances, a full refund will be issued to the Renter.
6. Governing Law and Jurisdiction:
6.1 This Agreement shall be governed by and construed in accordance with the laws of California.
6.2 Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of California.
7. Insurance:
Renter shall maintain, at renter's expense, liability, property, and casualty insurance coverage in an amount sufficient to fully protect Party Perfect LLC and it's equipment against any and all claims, loss, or damage of whatever nature type.
By checking this box, the Renter acknowledges that they have read, understood, and agreed to all the terms and conditions stated in this Rental Agreement.
